These Terms of Use (the “Terms”) govern your access to and use of the website at thegoodcfo.com (the “Site”) and, for TGCFO clients and authorized users, The Good CFO Hub (the “Service”), each provided by The Good CFO (“TGCFO,” “we,” “us,” or “our”). By accessing the Site or using the Service, you agree to these Terms. If you do not agree, do not use the Site or the Service.
1. Using the website
You may access and use the Site for lawful, informational purposes. You agree not to misuse the Site — including by disrupting it, attempting to gain unauthorized access to it or its underlying systems, introducing malicious code, or scraping, harvesting, or reproducing its content except as permitted by these Terms or applicable law.
2. Not professional advice
The content on the Site is provided for general informational purposes only. It is not accounting, tax, legal, investment, or other professional advice, and it does not create a client, advisory, or fiduciary relationship. You should consult a qualified professional before acting on anything you read here. Any engagement with TGCFO is governed by a separate written agreement.
3. Inquiries and submissions
When you contact us or submit a form through the Site (for example, to schedule a conversation or apply to the CFO Collective), you are responsible for the accuracy of the information you provide. How we handle information you submit is described in our Privacy Policy.
4. Intellectual property
The Site and the Service — including all software, design, content, text, graphics, trademarks, and the TGCFO methodology — are and remain the exclusive property of TGCFO and its licensors. Except for viewing the Site in the ordinary course, no rights are granted to you other than those expressly described in these Terms.
5. Third-party links and services
The Site and the Service may link to or integrate with third-party websites and services (for example, scheduling tools, LinkedIn, and accounting integrations). We do not control and are not responsible for the content, policies, or practices of those third parties, and your use of them is governed by their own terms.
6. The Hub — End-User License Agreement
The following additional terms apply if you access The Good CFO Hub as a TGCFO client or authorized representative:
- License grant. Subject to your compliance with these Terms, TGCFO grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service solely for your internal business purposes as a TGCFO client or authorized representative of a TGCFO client.
- Restrictions. You agree not to: copy, modify, or create derivative works of the Service except as expressly permitted; reverse engineer, decompile, or attempt to derive its source code; resell, sublicense, lease, or otherwise transfer access to the Service to any third party; use the Service to develop a competing product, or to benchmark or train any machine-learning model; or use the Service in any manner that violates applicable law or the rights of any third party.
- Customer data. You retain all right, title, and interest in any data you (or your authorized integrations, including QuickBooks Online and similar third-party services) submit to or generate through the Service (“Customer Data”). You grant TGCFO a limited license to process Customer Data solely to provide and improve the Service for you. TGCFO will not use Customer Data to train machine-learning models or sell it to third parties.
7. Disclaimer of warranties
The Site and the Service are provided on an “as-is” and “as-available” basis. To the fullest extent permitted by law, TGCFO disclaims all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and does not warrant that the Site or the Service will be accurate, uninterrupted, or error-free. The Service is a decision-support tool; it is not a substitute for professional accounting, tax, legal, or financial advice.
8. Limitation of liability
To the fullest extent permitted by law, TGCFO will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Site or the Service. Our aggregate liability for any direct damages will not exceed the amount you paid TGCFO for the Service in the twelve months preceding the event giving rise to the claim, or one hundred U.S. dollars (USD 100.00) if no such payment was made.
9. Term and termination
These Terms apply while you use the Site or the Service. We may suspend or terminate access at any time. Upon termination of your Hub access, your right to use the Service ceases; on request, TGCFO will return or delete your Customer Data within a reasonable period, except where retention is required by law.
10. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in California.
11. Changes to these Terms
TGCFO may modify these Terms from time to time. We will post the updated Terms at this URL and update the effective date. Your continued use of the Site or the Service after changes take effect constitutes acceptance of the revised Terms.
